POWER OF ATTORNEY REGARDING PROCEDURES TO BE EXECUTED AT LAND REGISTRY OFFICE
According to article 89 of Notary Public Law, power of attorneys necessitating carrying out procedures at real estate registration office in terms of their peculiarity should be made in “arrangement” form. The procedure in the form of arrangement is prepared by the notary public personally if a power of attorney is to be issued in Turkey and by the Turkish Consulate if a power of attorney is to be issued abroad according to the situation and wish of the related person in form of a written report. Therefore, the procedures (work papers) can only be prepared upon the application of the related person personally to the Turkish Consulate together with his/her identity card, valid passport and two newly taken passport photos.
Acceptance of power of attorneys directly prepared or approved by the competent authority of a foreign country is not possible in Turkey unless they are approved by the Turkish consul or political officials in that foreign country. Power of attorneys prepared directly by the competent authority of a foreign country must be approved by the Turkish Consulate and political officials in that foreign country. The ratification note is called ‘Apostille Convention’.
